A release authorisation (Löschungsbewilligung) allows you to have a registered land charge removed from the land register (Grundbuch). This takes place once the loan secured by the land charge has been fully repaid. In this case, the lender – typically the bank – grants permission to release the land charge, which is why the document is known as a “release authorisation.”

How the Release of a Land Charge Works
Once the loan has been fully repaid, the bank issues a release authorisation (Löschungsbewilligung). If the land charge is a so-called certificated land charge (Briefgrundschuld), the property owner also receives the land charge certificate from the bank. The owner then signs a notarially certified application for the release of the land charge at the notary’s office. The notary forwards the application, together with the release authorisation and, where applicable, the land charge certificate, to the land registry (Grundbuchamt). The land charge is then removed from the land register.
Should I Release the Land Charge - Yes or No?
A land charge remains in effect even after the loan it secured has been fully repaid and functions as a so-called owner’s land charge (Eigentümergrundschuld) in the land register. This means the bank can quickly reuse it as security for a new loan, provided no release authorisation is applied for and the land charge remains registered. In that case, the property owner would simply need to sign a new purpose declaration (Zweckerklärung) with the bank to reactivate the land charge as security for a new loan. This could save the costs of releasing the existing land charge and registering a new one.
